1) Overview
By opting in, you agree to receive SMS messages from Lending Hand Mortgage ("we," "us," "our") (the "Messaging Program"), and you agree to these Terms & Conditions ("Terms"). Our Messaging Program is an Application to Person (A2P) service delivered over carrier‑sanctioned channels, including 10 Digit Long Code (10DLC). Message frequency may vary. Message & data rates may apply.
You can cancel the SMS service at any time by replying STOP. For help, reply HELP or contact admin@lhmtg.com.
Carriers are not liable for delayed or undelivered messages. Consent to receive SMS messages is not a condition of purchase. Additional details follow.
2) Eligibility & Program Description
The Messaging Program may include (as applicable): account alerts, appointment reminders, transactional notifications, customer support messages. The nature and frequency of messages will be disclosed at the point of opt‑in. Message frequency varies. Standard message and data rates may apply.
3) Consent to Receive Messages
3.1 Prior Consent Required
You must provide valid consent before we send you messages. For informational messages, express consent is required; for marketing messages, prior express written consent is required (electronic signatures accepted).

3.2 How We Collect Consent
Consent may be collected via:
- (a) web forms with an unchecked checkbox;
- (b) SMS keyword opt‑in;
- (c) paper or electronic forms; or
- (d) voice enrollment with appropriate disclosures.
We record and maintain consent evidence and may be asked by carriers to produce it. - 3.3 Consent Disclosures (At Opt‑in)
At the time of opt‑in, we disclose: our business name, message purpose, message frequency, that message/data rates may apply, links to these Terms and our Privacy Policy, and how to get help or opt out.
4) Opt‑Out / Stop Commands
You can opt out at any time by texting STOP to any message. After you send STOP, you may receive one final message confirming your opt‑out. You may also opt out via Admin@lhmtg.com or our client portal (if applicable). We honor opt‑out requests promptly and within carrier‑required timeframes.

6) Message Types & Quiet Hours
6.1 Message Types
We send transactional or informational messages to customers who have given consent; marketing messages are only sent with prior express written consent.

6.2 Quiet Hours
We strive to send marketing messages only between 8:00 a.m. and 9:00 p.m. local time for the recipient, consistent with prevailing industry practices and applicable laws.
7) Program Registration & A2P Compliance
7.1 10DLC Registration
We register our brand and campaigns with The Campaign Registry (TCR) or through our messaging provider, as required by U.S. carriers, and maintain accurate campaign use cases and sample messages.
7.2 CTIA Guidelines
We follow CTIA Messaging Principles and Best Practices, including clear calls to action, opt‑in confirmation for recurring programs, opt‑out support, brand identification in messages, and avoidance of snowshoeing or other evasion tactics.
7.3 Carrier & Aggregator Policies
Our Messaging Program is subject to policies of carriers and connectivity partners. Messages may be blocked or filtered if they violate content, consent, frequency, or throughput rules. We monitor performance and compliance and may suspend messaging to protect recipients and comply with carrier directives.
8) Prohibited Content
We prohibit sending messages that are unlawful, deceptive, fraudulent, threatening, harassing, or otherwise unwanted; that promote illegal substances, hate, or violence; or that include phishing, malicious links, or attempts to evade filters (e.g., snowshoeing, grey routes). Embedded links or numbers must not mislead recipients.
9) Data Privacy & Security
We maintain and conspicuously display a clear, easy‑to‑understand Privacy Policy describing data collection, use, sharing (including that we do not sell consent lists), and security controls. We implement reasonable physical, administrative, and technical safeguards and conduct periodic reviews.

10) Fees & Charges
Your carrier's message and data rates may apply. We do not charge you for receiving standard program messages; however, premium services (if any) will be disclosed at opt‑in with applicable fees.
11) User Responsibilities
You represent that:
- (a) you are the account holder or customary user of the mobile number you provide;
- (b) you have authority to consent to receive messages; and
- (c) you will notify us if the number changes or is reassigned.
We may confirm your number via message or call and may employ reasonable measures to address number reassignments.
12) Program Changes & Suspension
We may modify or suspend the Messaging Program, or change message frequency, content, or channels, in response to carrier requirements, regulatory changes, or business needs. Material changes will be communicated via message or website notice.
13) Disclaimers; Limitation of Liability
Messaging is provided "as is" and "as available." Delivery is subject to carrier networks and may be delayed or undelivered. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages related to messaging, except as required by applicable law. This clause does not limit any rights or remedies under the TCPA or similar statutes.
14) Dispute Resolution
Any disputes related to these Terms or the Messaging Program will be resolved under the governing law of the state indicated in Section 15, with venue in the courts specified below, unless otherwise required by applicable consumer protection laws.
Optional: You may include binding arbitration and a class action waiver provision here. Consult legal counsel to tailor any arbitration terms, consumer carve‑outs, and forum selection.

16) Entire Agreement; Updates
These Terms constitute the entire agreement between you and Lending Hand Mortgage regarding the Messaging Program. We may update these Terms periodically. Updates will be posted on our website with the "Last updated" date above. Continued use of the Messaging Program constitutes acceptance of the updated Terms.
17) Supported Carriers & Delivery
Delivery of messages is subject to the coverage and performance of mobile carriers and networks. Not all carriers or devices support all message types (e.g., MMS, links, images). Carrier or aggregator maintenance windows may temporarily disrupt delivery.
18) Contact Methods & Short Code/Long Code
Unless expressly stated otherwise, messages will be sent from our registered A2P numbers and/or approved short code. For STOP and HELP commands, use 877-618-5363 associated with your opt‑in. If you opt in through multiple programs or numbers, you may need to opt out separately for each.
19) Accessibility

20) Contact Preferences
You may manage preferences (e.g., marketing vs. transactional) via our opt‑in flow or account settings (if available). Opting out of marketing messages does not affect transactional messages required to service your account (where permitted by law and with appropriate consent).
